Who you are buying from

Diversi Valley is a trading name of Key To Achieving Therapy Services Ltd. Diversi Valley is not a separate legal entity. Your contract is with Key To Achieving Therapy Services Ltd.

These terms apply to anything you buy from the Diversi Valley website. By placing an order, you accept them.

Nothing we sell is clinical advice

This is the most important term in this document.

Our resources are educational and informational. They are not a clinical assessment, a diagnosis, or individual clinical advice. Buying a resource does not create a therapist and client relationship between you and Katie Simons, or between you and Key To Achieving Therapy Services Ltd.

Nothing we sell replaces advice from a qualified professional who knows the individual concerned. If you are worried about yourself or about someone else, speak to a professional.

You are responsible for how you apply these resources, and for any decision you make as a result.
 

What we sell

We sell digital resources, written guides and clinical tools, supplied as downloads. We may also offer bookable sessions and organisational licences, which are described on the relevant page of the website.

Every resource has a full description on its product page, setting out what it covers and who it is for. Please read it before buying.

Format and compatibility

Our resources are supplied as PDF files unless the product page says otherwise. To open them you need a device capable of reading PDF files. Most computers, tablets and phones can do this without additional software.

Our resources carry no digital rights management and no regional restriction.

If you are unsure whether you will be able to open a resource, contact us before buying and we will tell you.
 

Price, payment and delivery

Prices are shown on the website and include VAT where it applies. Payment is taken at the point of purchase.

Digital resources are supplied immediately, by email or by download link. If you do not receive yours, email katie@diversivalley.com and we will resolve it.
 

Your right to cancel

You normally have 14 days to cancel something bought online.

For digital content supplied immediately, that right is lost once the download begins, provided you have agreed to it.

At checkout you are asked to tick a box confirming two things: that you want your download supplied immediately, and that you understand you will lose your right to cancel once it begins. The box is not pre-ticked. You must tick it yourself. Your order confirmation will restate that you gave this consent and this acknowledgement.

If you do not tick it, we will not supply the download for 14 days, and you keep your right to cancel throughout that period.
 

Bookable sessions. You have 14 days to cancel a booking. If you ask us to begin work within that period and we do, you may be charged for the work already carried out, in proportion to the whole.

To cancel, email katie@diversivalley.com. You may use the model cancellation form at the end of this pack, but you do not have to. Any clear statement that you are cancelling is sufficient. Refunds are made within 14 days of you telling us, using the same payment method you used to pay.
 

If something is wrong with what you bought

Under the Consumer Rights Act 2015, digital content must be of satisfactory quality, fit for purpose, and as described.

If a resource is faulty, does not work, or is not as described, you are entitled to have it repaired or replaced. If that is not possible, or does not resolve the problem, you are entitled to a refund. Email katie@diversivalley.com and we will put it right.

Nothing in these terms affects your statutory rights.

We do not refund a downloaded resource simply because you have changed your mind, or because the content is not what you assumed it would be. This is why every product page carries a full description.
 

What you may and may not do with what you buy

You are buying a licence to use the resource. You are not buying the copyright in it.

You may:

  • Use it yourself

  • Use it in your own professional practice, with the individuals you work with

  • Print a copy for your own use

You may not:

  • Share, forward, upload, copy or resell it

  • Use it to train staff or teams without an organisational licence

  • Reproduce any part of it within your own materials, training or resources

  • Remove any copyright notice from it
     

All frameworks, models and written content published by Diversi Valley, including the SPINE Framework, remain the intellectual property of Key To Achieving Therapy Services Ltd. If you wish to use this work across an organisation, contact us about licensing.
 

Our liability

We do not exclude or limit our liability where the law does not permit it. This includes liability for death or personal injury caused by our negligence, for fraud, and for breach of your statutory rights as a consumer.

Subject to that, our total liability to you for anything arising from the website, or from anything bought through it, is limited to the amount you paid us.

We are not liable for indirect or consequential loss, or for any outcome resulting from how you have chosen to apply a resource.

If you are buying as a business rather than as a consumer, we are not liable for loss of profit, business, contracts or anticipated savings.
 

Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in your own courts.

Acceptable use

You must not use this website:

  • In any way that breaks the law

  • To transmit any harmful, defamatory or unlawful material

  • To attempt to gain unauthorised access to it, or to interfere with its operation

  • To harvest data from it, whether manually or by automated means
     

Links to other websites

Where we link to another website, we do so because we consider it useful. We do not control those websites and are not responsible for their content or their handling of your information.
 

Availability

We aim to keep the website available but do not guarantee it. We may change or withdraw content at any time. If you have already bought a resource, you keep access to it.
